Terms of Service: updated sections

Replace these sections with the versions below.

Section 4 – Prices and payment

Prices are shown in euros (EUR) for customers in the European Union and in pounds sterling (GBP) for customers in the United Kingdom, and include VAT where applicable. Shipping costs are shown clearly at checkout before you complete your order. The price you pay is the price shown when you place your order, as confirmed in your order confirmation email.

Prices, discounts and promotions may change from time to time, but changes will not affect orders we have already accepted. Promotions may have their own terms. If those terms conflict with these Terms, the promotion terms apply.

You agree to provide current, complete and accurate payment information and confirm that you are authorized to use the payment method you choose.

Section 5 – Shipping and delivery

We ship orders to the European Union and the United Kingdom. Delivery times shown on our website are estimates. Unless we agree otherwise, we will deliver your order within 30 days of accepting it. If we fail to deliver within that time, or within an additional period you give us, you may cancel your order and receive a full refund.

Responsibility for your order passes to you once you, or someone you have chosen, physically receive it.

Section 10 – Privacy

All personal information we collect through the Services is handled in accordance with our Privacy Policy and applicable data protection law, including the EU General Data Protection Regulation (GDPR), the UK GDPR and the UK Data Protection Act 2018. Some personal information may also be processed under Shopify's Privacy Policy.

Because our store is hosted by Shopify, Shopify and our service providers process personal information to operate and improve the Services. Some of these providers may be located outside your country. Please see our Privacy Policy for full details, including your rights.

Section 15 – Your legal rights if something is wrong

We are legally responsible for delivering products that match their description, are of satisfactory quality and are free from defects.

Customers in the European Union: you have a legal guarantee of at least 2 years from delivery. If a product is faulty or not as described, you are entitled to a repair or replacement, or, where that is not possible, a price reduction or refund.

Customers in the United Kingdom: under the Consumer Rights Act 2015, you can reject a faulty product and get a full refund within 30 days of delivery. After 30 days, you are entitled to a repair or replacement, and if that doesn't fix the problem, a price reduction or refund. You may have up to 6 years to make a claim (5 years in Scotland).

General information on our website is provided for information purposes. We do not guarantee that the website will always be available, uninterrupted or error-free.

Terms of Service: final sections

Section 20 – Transfer of rights

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another organization, but this will not reduce your rights under these Terms, and we will let you know if it happens.

Section 21 – Governing law and disputes

These Terms are governed by the laws of UK.

If you are a consumer living in the European Union, you also benefit from the mandatory consumer protection laws of your country of residence, and you may bring legal proceedings in the courts of your country.

If you are a consumer living in the United Kingdom, you also benefit from the mandatory consumer protection laws of the part of the UK where you live. You may bring legal proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts of your home nation.

Headings in these Terms are for convenience only and do not affect their meaning.

Section 23 – Changes to these Terms

You can review the latest version of these Terms at any time on this page. We may update these Terms from time to time, for example to reflect changes in the law or in our Services. We will notify you of important changes as required by law. The Terms in effect when you place an order apply to that order.

Refund policy: UK updates

Change the withdrawal heading and first sentence to:

Your 14-day right to cancel (EU and UK customers)
If your order is delivered within the European Union or the United Kingdom, you have the legal right to cancel your order within 14 days of receiving it, for any reason and without giving a justification.

Replace the last two sentences of the "Damaged or faulty items" section with:

This doesn't affect your legal rights. EU customers have a 2-year legal guarantee, and UK customers are protected by the Consumer Rights Act 2015, including the right to a full refund for faulty items within 30 days of delivery.

Before you start selling in the UK

I'm not a lawyer or tax advisor, so check these with an accountant or advisor:

  • UK VAT: for orders worth £135 or less shipped from abroad, the seller usually has to register for UK VAT and charge it at checkout. Shopify can handle this once you're registered.
  • Customs duties: decide whether you pay import costs (prices "including duties," as in the bracketed Section 4 sentence) or the customer pays on delivery. Surprise fees at the door are a common cause of refused parcels and bad reviews in the UK. If the customer pays, delete that sentence and say so clearly at checkout.
  • Trademark: an EU trademark doesn't cover the UK, so file "Nordic Jackets" with UKIPO as well.
  • Labels: UK rules also require fibre composition labels in English.
  • Company details: fill in Section 24. Both EU and UK rules require online shops to show their legal name, address, and registration details.
